An Enduring Guardianship is a legal document enabling the person appointed to act on your behalf should you not be capable of making decisions concerning your health and welfare. The appointment of an Enduring Guardian allows the person or persons chosen by you to make decisions on your behalf, as to your welfare, medical treatment and should the situation arise, as to whether you stay on or are taken off life support.
This is a very important document to have. It exists for the duration of your life and ceases upon death. The will then takes over.
In some instances where the person is terminally ill, we recommend the drafting of an aditional document in the form of a Statutory Declaration which is attached to the Enduring Guardianship and handed to the Doctor in charge. Please telephone us to discuss your particular need.
