POWER OF ATTORNEY
A Power of Attorney is a legal document enabling the appointee to act in the same capacity as the Principal in relation to financial matters. It does not allow the appointed person to make medical decisions which is the prime purpose of an Enduring Guardianship, a separate document to the Power of Attorney.
This document is a living document in that it holds legal form while the person is alive and ceases upon death.
The person appointed must sign an acceptance certificate prior to that person having the right to act on the Power of Attorney.
Where real property is involved the Power of Attorney must first be registered at the LPMA before it can be used by the appointed person.
